My Disability Claim Was Denied: What’s Next?

Suffering with a disability that renders you unable to work is tough. When you’ve been denied a disability claim, that can make the stress seem more insurmountable. That being said, you do have options even after your claim has been denied. Just because your claim is denied, doesn’t mean you don’t have any farther right to benefits.

1) Find out why

If you decide to dispute the claim, you’ll need to find out the reasons why and you need the insurance agency to put this in writing. Remember, to qualify for long term disability, this means you must not be able to perform your job.

Also, some conditions, such as chronic pain or psychological issues, are not as easy to prove, which makes it difficult when filing disability claims. Other reasons may include not completing tasks required by the insurance company, failing to provide documentation regarding your injury, or you are seeking disability for a pre-existing condition.

2) Filing an appeal and preparing for litigation

If you decide to file an appeal regarding the denial of your disability claim, you want to hire personal injury lawyer who has a history of successful appeals. Ideally, meet with a lawyer who has experience going up against the larger insurance agencies – and has been successful in fighting these appeals.
