There are a number of different categories of damages in personal injury actions. There is no “cap” or “maximum” on most personal injury awards. However, there is a cap/maximum on the amount that you can receive or settle for pain and suffering in an injury lawsuit.
Years ago, the Supreme Court of Canada decided that there would be a cap or limit on the amount that you can receive for pain and suffering due to an injury. The amount is subject to inflation and is likely in the neighborhood of $328,000 (approx.) at present.
